OECD rates Mauritius as a ‘Largely Compliant’ jurisdiction

In line with the international movement towards more transparency and exchange of information, Mauritius has been constantly implementing steps to enhance its legal and regulatory framework for exchange of information. A testimony to this is the "Largely Compliant" rating attributed to Mauritius by the Organisation for Economic Co-operation and Development's (OECD's) Global Forum on Transparency and Exchange of Information for Tax Purposes.

 

The forum’s term for reference for monitoring and reviewing progress towards transparency and exchange of information is concerned with the availability of relevant information within a jurisdiction, the competent authority’s ability to gain access to that information and whether that information can be effectively exchanged on a timely basis with its exchange of information partners. Based on the recommendations of the organisation, Mauritius:

 

a. has amended its Companies Act to require companies to maintain beneficial ownership information in respect of nominee shareholdings and its Trusts Act to require trustees of non-resident foreign trusts to keep identify information and all trustees to keep underlying information

 

b. is actively engaged in negotiating new treaties and in the updating of existing treaties to upgrade exchange of information clauses

 

c. has demonstrated its ability to exchange information, at an international standard, in respect of all its taxpayers, including companies operating in the Global business sector.

 

In its Second supplement Peer Review, the OECD has acknowledged the effort and progress made by Mauritius in successfully implementing the various measures that were recommended by the organisation and consequently positively revised the rating of Mauritius. Mauritius has now a rating of “Compliant” for 8 key elements and of “Largely Compliant” for the remaining 2 elements with an overall rating of “Largely Compliant”. The Forum concluded, following the review, that the Mauritius Exchange of Information system was effective and efficient and was compliant with the international standards.
